 INTRODUCTION 

 Through our Websites and Platforms, EMDEE Ohio, LLC (“EMDEE,” “we,” “us,” or “our”) offers various online services that enable visitors to the Websites and Platforms (“you” or “Visitors”) to receive access to various types of healthcare information and information about our other services we may provide (“EMDEE Services”). 

EMDEE understands that privacy of information is of great importance to our Visitors. 

 APPLICABILITY OF THIS PRIVACY POLICY 

 This Privacy Policy (“Privacy Policy”) describes what information EMDEE collects about Visitors on the publicly available portions of its Websites and Platforms and how that information is used. 

 AGREEMENT TO THIS PRIVACY POLICY 

 Your access and use of the Websites and Platforms are subject to your agreement with this Privacy Policy and the Terms and Conditions of our Websites and Platforms. By using the Websites and Platforms, you expressly agree to the terms of this Privacy Policy and consent to the collection and use of information as discussed in this Privacy Policy. 

 MODIFICATIONS TO THIS PRIVACY POLICY 

 EMDEE may revise this Privacy Policy regarding the collection of information at any time. Should this Privacy Policy change materially, EMDEE will give notice to you by posting a notice regarding the new policy on the Websites. The revised Privacy Policy will be effective as of its posting unless otherwise stated. 

By accessing or using the Websites and Platforms after such changes are posted you agree to all such changes. 

COLLECTION, USE AND DISCLOSURE OF INFORMATION 

Either EMDEE or a third party vendor on behalf of EMDEE may automatically collect information while Visitors browse the Websites and Platforms. We may collect such information by tracking, or asking a third party vendor to track, your click-stream activity when such information is not tied to a user ID through the use of “cookie” technology or by tracking internet protocol (IP) addresses, as explained below. 

Because we want our Websites and Platforms to better serve Visitors’ needs, we collect some basic information about Visitors and their devices, including, but not limited to: 

  • IP address (the computer’s address on the Internet) 
  • Operating system (e.g. Windows Vista) 
  • Browser software (e.g. Microsoft Internet Explorer, Firefox) 
  • Internet Service Provider (e.g. AOL) 
  • Geographic location (e.g. Boston, Mass.) 
  • Type of device (e.g. iPad, desktop) 
  • Mobile device crash information 
  • Locale and language of device and whether it has fingerprint/face sensors 
  • Dates and time you accessed and used the Website, features you used in the Website, and how long you use the Website overall 
  • Links you click and pages you view within the Website 
  • Pages you view before and after you leave the Website 

We use this information to continuously enhance our Websites and Platforms and to better serve our Visitors’ needs. For example, we use this information to know what browsers people most commonly use, what pages are most often visited, and what functionality is most used. Some of the information we collect from Visitors, such as IP Address, may be considered identifiable personal information (“Personal Information”). Additionally, there are times on our Websites and Platforms that Visitors are able to voluntarily submit Personal Information, such as their name, phone number, and/or email address in order to obtain more information from EMDEE. We may remove personal identifiers from your Personal Information and maintain and use it in a de-identified form (“De-Identifiable Information”). De-Identifiable Information and Personal Information are collectively referred to throughout this Privacy Policy as “Information”. 

The Information collected from Visitors may be shared with our suppliers and vendors and used in the aggregate to create summary statistics that help us analyze usage trends, assess what information is of most and least importance, determine technical design specifications, arrange the Websites in the most user-friendly way, and identify system performance or problem areas. 

By continuing to use the Websites and Platforms, you hereby consent to the use and disclosure of your Information as set forth below: 5278253.2 

  • within EMDEE or with our service providers such as a cloud service provider for data storage; 
  • with our financial, insurance, legal, accounting or other advisors that provide professional services to us; 
  • to respond to a subpoena, order, legal process, or government request; 
  • to protect, establish or exercise our legal rights or defend against legal claims; 
  • to investigate, detect, suppress, prevent or take action regarding illegal or prohibited activities, suspected fraud, situations involving potential threats to the reputation or physical safety of any person; 
  • if we are to be sold, merged, or amalgamated or substantially all of our assets are to be sold or disposed of, your personal information may be transferred to a potential purchaser if, and to the extent necessary, it is required for the purposes of deciding whether to proceed with the proposed transaction and completing it. If such a sale, merger, acquisition, or disposal is completed, we will use reasonable efforts to direct the transferee to use personal information you have provided to us in a manner that is consistent with this Privacy Policy. Following such a sale or transfer, you may contact the entity to which we transferred your personal information with any inquiries concerning the processing of that information; or 
  • as otherwise required by law. 

COOKIES 

Like many companies, we use “cookies” to help you better navigate the Websites and Platforms. A “cookie” is a small piece of information sent by EMDEE’s web-based applications that are stored by your web browser on your computer’s hard drive. Cookies enhance your online experience by saving your preferences while you are visiting a particular Website. The cookies do not contain any identifiable information and cannot profile your system or collect information from your hard drive. Most Internet browsers automatically accept cookies, but you can set your browser to refuse them or to alert you when they are being sent.

Links to Third-Party Services 

We may provide links to third party websites, services, and applications that are not operated or controlled by us (“Third-Party Services”). While we attempt to facilitate access only to those Third-Party Services that share our respect for your privacy, we cannot take responsibility for the content, privacy policies, or practices of those Third-Party Services. We encourage you to review and understand the privacy practices of any Third-Party Services before providing any information to or through them. Your interactions with these features are governed by the privacy policy of the Third-Party Service that provides the feature. Where possible, we will warn you when you are leaving our Site and connecting to a site operated by a third party. 

Consent to Communications 

By using the EMDEE Services and providing your contact information, such as your name, phone number, and email address, you consent to receiving email and text messages to tell you about the EMDEE Services. We may share your information with partner organizations whose products or services are important for EMDEE Services objectives. For example, we may provide your information to third parties that assist EMDEE for hosting our databases, for data processing services, or so they can contact you with information that you requested as part of the EMDEE Services. However, we do not exchange, trade, rent, or give phone or email lists to unaffiliated third parties, and third parties that receive your information from EMDEE are restricted from using this information in any way other than to provide services to EMDEE, or services for a collaboration in which they and EMDEE are engaged. You may opt-out from receiving email communications at any time by emailing support@myemdee.com. You may opt out from receiving text message communications at any time by replying to the text message with “STOP”. At that time, we will send a final text message confirming receipt of your opt-out notification. 

Children’s Privacy 

You must be 18 years of age or older in order to establish an account on and use the Service. EMDEE is concerned about the safety and privacy of children online. Because of this, we will make all efforts to comply with the Children’s Online Privacy Protection Act of 1998 (COPPA). COPPA and its accompanying FTC regulations establish United States federal law that protects the privacy of children using the internet. We do not and will not knowingly contact or collect Personal Information from children under 18. Our site is not intended to solicit information of any kind from children under 18, and we will develop our site with the capacity to block acceptance of information from children under 18 whenever age-related information is requested. 

It is possible that by fraud or deception by others we may receive information given to us or pertaining to children under 18. If we are notified of this, as soon as we verify the information, we will immediately obtain parental consent or else delete the information from our servers. California Privacy Rights 

If you are a resident of California, you may: 

• request the categories and/or specific pieces of Personal Information collected about you, including whether your Personal Information is sold or disclosed, and with whom your Personal Information was shared; 

• Access a copy of the Personal Information we retain about you; 

• Request deletion of your Personal Information; 

• Correct or amend your Personal Information; 

• Object to certain uses of your Personal Information. 

We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use Personal Information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request. In addition, we may allow you the option to opt out of sharing Information rather than providing information about third parties with whom we share Information. 

If you would like to make a request for more information, please send an email message to support@myemdee.com with “Request for California Privacy Information” in the subject line of your message. Your request should: 1) provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative; and 2) describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. We will not discriminate against you by denying goods or services, charging different rates for goods or services, or provide a different level or quality of goods or services, for exercising any of your rights. 

YOUR RIGHTS REGARDING YOUR PERSONAL INFORMATION 

Amendment. You have a right to request that EMDEE amend or delete the Personal Information it collects from your use of the Websites or Platforms if you believe it is incorrect or incomplete, and you may request an amendment or deletion for as long as the Personal Information is retained by EMDEE. You must submit your request in writing to EMDEE and provide a reason to support the requested amendment. EMDEE may, under certain circumstances, deny your request by sending you a written notice of denial. 

Withdrawal of Consent. Subject to applicable law, you may withdraw your consent to uses and disclosures of Personal Information as outlined in this Privacy Policy. You must submit your request in writing to EMDEE. Withdrawing consent does not invalidate consent to any collection, use or disclosure of Personal Information to which you consented before consent was withdrawn. If you withdraw consent, or refuse further consent, EMDEE’s ability to offer services to you may be limited. 

Privacy Policy Updates 

EMDEE reserves the right to revise its Privacy Policy at any time. Such amendments will be posted in the Privacy Policy section of the Website. You can determine whether the Privacy Policy has been modified since you last visited the Website by checking the “Last updated” legend at the top of the Privacy Policy. As stated above, the spirit of this Privacy Policy will be maintained, and our policy to never sell, exchange, rent, trade, or give your Personal Information to unauthorized third parties will not be altered.
